1. Agreement to These Terms
These Terms of Service form an agreement between you and KamariMail regarding your access to and use of the KamariMail website, secure messaging platform, applications, and related services.
By creating an account, accessing the platform, or using the services, you agree to these Terms. If you use KamariMail on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility and Accounts
You must provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for activity performed through your account.
You must promptly notify KamariMail of suspected unauthorized access, compromised credentials, or other account-security concerns.
3. Organization Accounts
Organization administrators may invite users, assign roles, manage permissions, configure workspace settings, and access administrative information associated with their organization.
Users whose accounts are controlled by an organization may be subject to that organization's policies and instructions.
4. Acceptable Use
You may not use KamariMail to:
- Violate applicable laws, regulations, or court orders.
- Send unlawful, fraudulent, abusive, or deceptive content.
- Harass, threaten, exploit, or harm another person.
- Distribute malware, malicious code, or harmful files.
- Attempt unauthorized access to accounts or systems.
- Interfere with service availability or security controls.
- Impersonate another person or misrepresent affiliation.
- Use the service for spam or unsolicited bulk messaging.
- Reverse engineer or misuse the service except where permitted by law.
5. Secure Messaging Responsibilities
KamariMail provides tools designed to support protected communication. You remain responsible for choosing appropriate recipients, reviewing message content, managing permissions, and complying with laws and contractual obligations applicable to your organization.
You must not rely on KamariMail as a substitute for emergency services, urgent medical communication, or any channel requiring immediate response.
6. Plans, Fees, and Billing
Paid services may be billed per user, per organization, by subscription period, or under a separate agreement. Pricing, included features, limits, taxes, and renewal terms will be disclosed before purchase.
Unless otherwise stated, fees are nonrefundable except where required by law or expressly provided in a written agreement.
7. Free and Trial Services
Free or trial access may include usage, feature, message, user, storage, or time limits. KamariMail may modify or discontinue free or trial offerings, subject to applicable law.
8. Customer Content
You retain ownership of content you submit to KamariMail. You grant KamariMail the limited rights necessary to host, process, transmit, secure, back up, and display that content for the purpose of providing the services.
You represent that you have the rights and permissions needed to submit and process your content through KamariMail.
9. Intellectual Property
KamariMail and its licensors retain all rights in the platform, software, design, branding, documentation, and related intellectual property, excluding customer content.
These Terms do not transfer ownership of KamariMail intellectual property to you.
10. Privacy
Personal information is handled as described in the KamariMail Privacy Policy. Organizations may also enter into additional data-processing or service agreements where appropriate.
11. Third-Party Services
KamariMail may integrate with or link to third-party services. Third-party services are governed by their own terms and policies. KamariMail is not responsible for third-party services outside its control.
12. Service Availability and Changes
KamariMail may update, improve, modify, suspend, or discontinue parts of the service. We will use reasonable efforts to provide notice of material changes when appropriate.
Service availability may be affected by maintenance, outages, security events, third-party providers, or circumstances beyond reasonable control.
13. Suspension and Termination
KamariMail may suspend or terminate access for nonpayment, security risk, legal requirement, violation of these Terms, or conduct that may harm users, third parties, or the service.
You may stop using the service or cancel a subscription in accordance with the applicable plan or agreement.
14. Disclaimers
To the maximum extent permitted by law, KamariMail services are provided on an “as is” and “as available” basis. KamariMail does not guarantee uninterrupted operation, error-free performance, or that every security threat can be prevented.
15. Limitation of Liability
To the maximum extent permitted by law, KamariMail will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities.
Any additional liability terms may be defined in an applicable order form, enterprise agreement, or other written contract.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold KamariMail harmless from claims arising from your unlawful use of the service, your content, or your violation of these Terms or third-party rights.
17. Governing Law
These Terms will be governed by the laws specified in the final customer agreement or, if none is specified, the laws of the State of Colorado, without regard to conflict-of-law rules.
18. Changes to These Terms
KamariMail may update these Terms as the service evolves. The effective date at the top of this page will be updated when changes are made.
